  Announcement of the Supreme People's Court of the People's Republic of China

  The "Supreme People's Court Interpretation on the Determination of State-owned Company and Enterprise Personnel in State-owned Controlled and Participated Joint-stock Limited Companies" was adopted at the 1359th meeting of the Judicial Committee of the Supreme People's Court on July 31, 2005, and is hereby promulgated and shall come into effect on August 11, 2005.

  August 1, 2005

  In order to accurately determine the State-owned company and enterprise personnel as defined in Chapter 3, Section 3 of the Special Part of the Criminal Law, the following interpretation is provided on the State-owned company and enterprise personnel in State-owned controlled and participated joint-stock limited companies:

  Personnel dispatched by State-owned companies and enterprises to State-owned controlled and participated companies to perform official duties shall be considered as personnel of State-owned companies and enterprises.
